Welcome to aquawerxgutters.com (the “Site”), owned and operated by Aqua Werx, LLC d/b/a Aqua Werx Seamless Gutters (“Aqua Werx,” “we,” “us,” or “our”), located at 605 Hoffmeyer Ln, Robinson, TX 76706. By accessing or using the Site, requesting a quote, or engaging our services, you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site.
1. Services Described
Aqua Werx provides residential and new-construction gutter services throughout Central Texas, including 5-inch and 6-inch seamless gutter installation, gutter repair, leaf gutter guards and cleaning, grading and drainage solutions, rainwater harvesting/collection tanks, rain barrels, rain chains, and seasonal Christmas light installation. Content on the Site is provided for general informational purposes about these services and does not constitute a binding offer until a separate written estimate or service agreement is signed by both parties.
2. Quotes, Estimates, and Scheduling
Quotes requested through the Site’s contact form or by phone are estimates based on the information and property details provided at the time of inquiry. Final pricing may vary following an on-site assessment, measurements, and identification of underlying issues (e.g., fascia damage, roofline changes, or drainage concerns) discovered before or during installation. Scheduling is subject to availability, weather conditions, and material lead times.
3. Workmanship Warranty
Aqua Werx offers a five (5) year workmanship warranty on qualifying installations, as described at the time of your service agreement. This warranty covers defects in our installation workmanship and does not cover manufacturer defects in materials (which may carry separate manufacturer warranties), damage caused by severe weather, acts of God, improper maintenance, unauthorized modifications, or normal wear and tear. Specific warranty terms will be provided in your service agreement or invoice.
4. Payment Terms
Payment terms, deposits, and accepted payment methods will be specified in your individual service agreement or invoice. Amounts not paid according to the agreed terms may be subject to late fees and collection action as permitted by Texas law.
5. Customer Responsibilities
You agree to provide accurate property information, ensure reasonable access to the work area, and disclose any known hazards (e.g., unstable structures, pets, buried utility lines outside standard utility-locate coverage) before scheduled work. Aqua Werx is not responsible for delays or additional costs resulting from inaccurate information or restricted access.
6. Intellectual Property
All content on the Site -including text, images, logos, graphics, photos of completed projects, and design elements -is owned by or licensed to Aqua Werx and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, or use Site content for commercial purposes without our prior written consent.
7. User Conduct
You agree not to use the Site to: submit false or fraudulent information; attempt to gain unauthorized access to our systems; upload harmful code; or use the Site in violation of any applicable federal, Texas, or local law.
8. Testimonials and Reviews
Customer testimonials displayed on the Site reflect individual experiences with our services. Results may vary based on property conditions, product selection, and other factors.

You agree to indemnify and hold Aqua Werx, its owners, employees, and subcontractors harmless from claims, damages, or expenses arising from your misuse of the Site or violation of these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Site shall be resolved in the state or federal courts located in McLennan County, Texas, and you consent to the personal jurisdiction of those courts.
